We may update and change our site from time to time to reflect changes to our offerings, our users' needs and our business priorities or for any other reason.

We may suspend or withdraw our site
Our site is made available free of charge.
We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of service and other applicable terms, and that they comply with them.

We may transfer this agreement to someone else
We may transfer our rights and obligations under these terms of service to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

You must keep your account details safe
If you create an account on our site, you represent and warrant that all required registration information you submit is truthful and accurate, and you will maintain the accuracy of such information. You may delete your account at any time, for any reason, by contacting us. We may also delete your account at any time, including but not limited to if you breach these terms of service.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of service.
If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@womenshealthweek.com.
We are not responsible and shall not be liable for any loss or damage you incur as a result of your identification code or password being compromised, or your account, information or data being compromised or otherwise used or accessed without your permission.

How you may use material on our site
We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws, other intellectual property laws, and treaties around the world. All such rights are reserved. You are not permitted to use our intellectual property without our written approval.
You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged (except where the content is user-generated).
You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
If you print off, copy, download, share or repost any part of our site in breach of these terms of service, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made (except that you are permitted to print off a copy of these terms of service).

The rights granted to you in these terms of service are subject to the following restrictions:  
(i) you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the site, whether in whole or in part, or any content displayed on the site;
(ii) you shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the site;
(iii) you shall not access the site in order to build a similar or competitive website, product, or service; and  
(iiii) except as expressly stated herein, no part of the site may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means. 

Unless otherwise indicated, any future release, update, or other addition to functionality or content of the site shall be subject to these terms of service. All copyright and other proprietary notices on the site (or on any content displayed on the site) must be retained on all copies thereof.

Rules about linking to our site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our site in any website that is not owned by you. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The website in which you are linking must comply in all respects with these terms of service. Uploading content to our site
Whenever you make use of a feature that allows you to create content directly on our site, upload or share content to our site, or to make contact with other users of our site, you must comply with the standards set out in these terms of service including but not limited to the acceptable use policy below. You warrant that any such contribution complies with those standards, and you agree you will be responsible for any loss or damage we suffer as a result of your breach of warranty. We will consider any content you upload to our site to be non-confidential and not protected by any trade mark, patent or copyright ("non-proprietary"), that is, in the public domain. You own your content, but you are required to grant us and other users of our site a limited licence to use, store and copy that content and to distribute and make it available to others. We also have the right to disclose your identity to anyone who is claiming that any content posted or uploaded by you to our site violates their intellectual property rights or their right to privacy. We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the acceptable use standards set out in these terms, in particular but not limited to the acceptable use policy. Acceptable Use Policy  
You agree not to use the site to collect, upload, transmit, display, or distribute any user content that:  
(i) violates any third party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right;
(ii) is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, intentionally misleading, libelous, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual or is otherwise objectionable; or  
(iii) is in violation of any law, regulation, or obligations or restrictions imposed by any third party.

You must not misuse our site by:  
(i) uploading, transmitting, or distributing to or through the site any computer viruses, trojans, logic bombs, worms, or any other material that is malicious or technologically harmful, or otherwise harmfully interacting with our site or any part of it, or any software intended to damage or alter a computer system or data;
(ii) sending through the site unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise;  
(iii) using the site to harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent;
(iv) interfering with, disrupting, or creating an undue burden on servers or networks connected to the site, or violating the regulations, policies or procedures of such networks;
(v) attempting to gain unauthorised access to the site (or to other computer systems, databases, servers or networks connected to or used together with the site, or any other equipment or network connected with our site) whether through password mining or any other means;  
(vi) harassing or interfering with any other user’s use and enjoyment of the site;  
(vii) interfering with, damaging or disrupting any software used in the provision of our site or any equipment or network or software owned or used by any third party on which this site relies in any way;  
(viii) attacking our site via a denial-of-service attack or a distributed denial-of-service attack; or  
(ix) using software or automated agents or scripts to produce multiple accounts on the site, or to generate automated searches, requests, or queries to (or to strip, scrape, or mine data from) the site (provided, however, that we conditionally grant to the operators of public search engines revocable permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials, subject to the parameters set forth in our robots.txt file).

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our site or any services provided via, or in relation to, our site for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes using (or permitting, authorising or attempting the use of):
(i) any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our site or any data, content, information or services accessed via the same; and
(ii) any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.

The provisions in this acceptable use policy should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).
You shall not use, and we do not consent to the use of, our site, or any data published by, or contained in, or accessible via, our site or any services provided via, or in relation to, our site for the purposes of developing, training, fine-tuning or validating any AI system or model or for any other purposes not explicitly set out in terms of service.  
The provisions in this acceptable use policy will not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

Enforcement
We reserve the right (but have no obligation) to review any user content, and to investigate and/or take appropriate action against you in our sole discretion if you breach the acceptable use policy above or any other provision of these terms of service or otherwise create liability for us or any other person. Such action may include removing or modifying your user content, terminating your account or your right to access the site, and/or reporting you to law enforcement authorities. By breaching some of the provisions of these terms of service, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Indemnity
If you are using the site in the course of business, you agree to indemnify us (and our officers, employees, and agents), including costs and reasonable legal fees, from any claim or demand made by any third party due to or arising out of:  
(i) your use of the site;
(ii) your breach of these terms of service;  
(iii) your breach of any applicable laws or regulations; or  
(iv) any content you upload or share through the site. 

We reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of these claims. You agree not to settle any matter without our prior written consent. We will use reasonable endeavours to notify you of any such claim, action or proceeding upon becoming aware of it.  

Rights you are giving us to use material you upload and feedback
When you upload or post content to our site, you grant us the following rights to use that content:
- a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the site and across different media including to promote our site or the service forever; and
- a worldwide, non-exclusive, royalty-free, transferable licence for other users, partners or advertisers to use the content in accordance with the functionality of our site indefinitely.

If you provide us with any feedback or suggestions regarding the site, you hereby assign to us all rights in such feedback and agree that we have the right to use and fully exploit such feedback and related information in any manner we deem appropriate. We will treat any feedback you provide to us as non-confidential and non-proprietary to you. You agree that you will not submit to us any information or ideas that you consider to be confidential or proprietary.

User-generated content is not approved by us
Our site may include information and materials uploaded by other users. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

Do not rely on information on this site
The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

We are not responsible for websites we link to
Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources, and we accept no liability in relation to such sites or resources.

We are not responsible for malware
We do not guarantee that our site will be secure or free from malware, including but not limited to bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access our site. You should use your own malware protection software.

Our responsibility for loss or damage suffered by you
Whether you are a consumer or a business user:
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation. To the maximum extent permitted by the applicable law, our aggregate liability to you for any loss or damage related to these terms of service and our site shall not exceed GBP £100 (one hundred pounds sterling). Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products or services to you, which will be set out in a separate document provided to you in relation to such products or services.

If you are a business user:
We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
(i) use of, or inability to use, our site; or
(ii) use of or reliance on any content displayed on our site.

In particular, we will not be liable for:
(i) loss of profits, sales, business, or revenue;
(ii) business interruption;
(iii) loss of anticipated savings;
(iv) loss of business opportunity, goodwill or reputation; or
(v) any indirect or consequential loss or damage.

If you are a consumer user:
We only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. If defective digital content that we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.

Which country's laws apply to any disputes
If you are a consumer, please note that these terms of service, their subject matter and their formation, are governed by English law. We both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland. If you are a business, these terms of service, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
